A career in the UK Armed Forces could never be described as ‘just another job’, nothing could be further from the truth. However, since the rules on Crown Immunity were relaxed in 1987, that is precisely how the British legal system views the military and those who serve, or served, in the Army, Navy, the Air Force or the Marines.     

In practical terms that means that since 1987 the same Health and Safety Legislation that applies to any civilian job or workplace applies in the exact same way to those in the forces.

Certain key exceptions do apply – most notably in combat situations – but for all other day to day duties and training exercises the Court will make little or no distinction from any other job when looking at issues of negligence and liability.

Prior to the rules being changed in 1987 military personnel who suffered injuries or illnesses because of their service – either in full or in part – had little recourse other than the Armed Forces own internal compensation schemes including the War Pensions Agency, Crown Immunity prevented civil action from proceeding. While we do not seek to be critical or such schemes, indeed they have been a financial lifeline for many former servicemembers, the awards very rarely amounted to what could have been made by a Court.
