From a legal perspective the Court view the MOD in the same way as they would any other employer and accordingly if you should suffer an injury while serving then it can and will be investigated in the same manner as any other accident at work.
Strict time limits do apply to accident cases and while the Court does have the discretion to extend such time limits, in our experience they rarely do so. What this means in practice therefore is that you must commence legal proceedings withing three years of the accident date otherwise you may forfeit your right to claim.
While accidents in the military can happen in a variety of ways and for a variety of reasons, the majority of cases we see do tend to come down to the same handful of causes :-
Poor training or no training at all
Faulty or missing equipment
Horseplay or fooling around
Lack of supervision
Trying to cut corners/rush a task
Due to the nature of the armed forces, accidents at work in a military environment have the potential to be very serious indeed. Even seemingly minor injuries can have a devastating affect on a career that requires peak physical and mental performance at all times.
If you have suffered an accident while serving in the armed forces contact PDA Law solicitors to see if we can help on a no win no fee basis.
